Every rupee an employer owes on the last working day — what it includes, typical timelines, and how to recover a stalled FNF.

What Does Full and Final Settlement Mean?

Full and final settlement (FNF) is the closing account between employer and employee when employment ends: payment of every earned but unpaid amount, return of company property, and issue of exit documents. It is not a single statute but a composite of obligations arising from the employment agreement, company policy, standing orders where applicable, and labour statutes.

Signing an FNF statement is consequential: it records what was paid and often acknowledges full satisfaction — read it before signing, not after.

  • Encashment of accrued earned leave as per rules or contract.

Timelines and Lawful Deductions

  • No single national statute fixes one universal FNF clock; several state shops-and-establishments laws prescribe windows, and industry practice commonly runs thirty to forty-five days from the last working day.
  • Statutory components carry their own clocks irrespective of internal practice — gratuity within thirty days of falling due is the classic example.
  • Notice-shortfall recovery is lawful only to the extent the contract provides and the deduction framework permits; arbitrary lump-sum forfeitures invite challenge.
  • Asset non-return can justify recovery of quantified value — documented valuation, not round-figure penalties.
Exit hygiene: email your last-working-day confirmation, handover completion and asset returns before leaving. The paper trail decides how fast a stalled FNF later moves.

1. How long can my employer legally take for FNF?

Follow your state's establishment act if it prescribes a window; otherwise contractual terms and the reasonableness standard apply, with thirty to forty-five days being accepted practice. Statutory heads like gratuity run on their own mandatory timelines regardless.

2. Can leave encashment be denied because I resigned?

Earned leave encashment on exit follows service rules, standing orders or statute depending on coverage — resignation does not extinguish accrued earned leave by itself. Casual or privileged leave categories differ; check which category your balance belongs to.

3. My employer says I must serve notice or pay two months' salary. Must I?

If your contract provides notice or salary-in-lieu, that obligation stands; quantum must match the contract, not improvised multiples. Conversely, deductions cannot push final dues below statutory entitlements even where breach is alleged.

4. Should I withdraw PF or transfer it to my new employer?

Transferring preserves continuity for pension purposes and compounding; withdrawal suits genuine long breaks. Frequent withdrawal-and-restart patterns lose both, which is why advisers generally prefer transfers between jobs.

5. Is withholding my experience letter lawful until I 'clear' some dispute?

Documents recording completed service are typically treated as independent entitlements; conditioning them on unrelated monetary disputes has been judicially discouraged. Demand them in writing alongside your dues claim.

6. I signed the FNF statement under pressure. Can it be reopened?

Possibly — agreements procured by coercion, or waivers of statutory dues like minimum wages and gratuity, face serious legal obstacles. Preserve the correspondence showing pressure and seek advice before assuming the signature closed everything.
